Authoritative version
This page is the authoritative right-of-withdrawal notice for consumers. Where it differs from other documents on this website (e.g. § 6 of the Terms & Conditions), the content of this page prevails.
Your statutory right as a consumer (§ 13 BGB)
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.
To exercise your right of withdrawal, you must inform us,
by means of a clear statement (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form, although this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your notice of the exercise of the right of withdrawal before the withdrawal period expires.
The model withdrawal form is also available on our documents page.
Reimbursement and compensation for value
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay, and no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement.
If you requested that the service should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of the right of withdrawal, compared to the total scope of the services provided for in the contract (§ 357 para. 8 BGB). The amount is calculated on a pro-rata basis: for time-based billing, according to the days elapsed until withdrawal in proportion to the booked period; for hour packages, according to the hours used at the agreed hourly rate. Any amount exceeding this will be refunded to you.
When the right of withdrawal ends
The right of withdrawal expires in the case of a contract for the provision of services (including digital services such as server hosting) if we have fully performed the service and we only began performance of the service after you had given your express consent and simultaneously confirmed your knowledge that you would lose your right of withdrawal upon full performance of the contract by us (§ 356 para. 4 BGB). For time-based billing, the service is fully performed only upon expiry of the booked period; for hour packages, upon complete use of the purchased hours.
Important
A clause such as "no withdrawal after X hours of use" would be invalid, because consumers may not be disadvantaged by deviating from §§ 355 et seq. BGB (§ 361 para. 2 BGB). The mechanism described above is economically equivalent and permissible: the customer pays for the time used, or the hours consumed, up to the point of withdrawal, and only the unused remainder is refunded.
Withdrawal and ordinary termination are two separate rights
Independently of the right of withdrawal, the contract can be terminated by ordinary notice at any time: after expiry of the minimum contract term, with seven calendar days' notice to the end of the respective billing period, including via the termination button pursuant to § 312k BGB (for details, see § 10 of the Terms & Conditions, Consumer block).
Immediate provisioning at checkout
If you choose immediate provisioning of your server at checkout, we obtain your separate, express consent for this via a mandatory checkbox. Without this consent, performance only begins after the 14-day withdrawal period has expired; with it, a compensation claim may arise under § 357 para. 8 BGB (see the "Consequences of Withdrawal" section above).
